  • The task is within their scope of practice.

  • Results of the task are predictable.
  • The task doesn’t require repeated nursing assessments.
  • The consequences of performing the task improperly are minimal and not life-threatening.

Nursing professionals are prohibited from delegating:

  • Nursing activities not within the delegating or supervising nurse’s scope of practice.
  • Activities for which the unlicensed person hasn’t demonstrated competence.
Penalties Under Section 4723.28, violations of the law under the Nurse Practice Act include, but are not limited to:

  • Committing fraud in passing a licensure examination.
  • Practicing nursing after failing to renew the required license.
  • Being convicted of a felony.
  • Illegally selling, giving away, administering, or self-administering drugs.
  • Practicing nursing under the influence of drugs or alcohol.
  • Assaulting or causing harm to a patient.
  • Engaging in activities that exceed the nurse’s scope of practice.
  • Aiding and abetting a person who is practicing without a license.

Any person who violates these provisions may be subject to a legal hearing and penalties which can include:

  • Denial, revocation, suspension, or restriction of a nursing license.
  • Reprimand or discipline as determined by the Ohio Board of Nursing.
  • Fine assessment of up to $500 per violation.
